Terms of Use

1. Acceptance of Terms

By accessing or using Guardian Connected (the "Platform"), you agree to be bound by these Terms of Use. If you do not agree, you must not use the Platform.

2. Consent Requirement — Non-Negotiable

Guardian Connected is designed exclusively for monitoring that has been explicitly consented to by the monitored user. Use of this platform requires that:

• The device user has been informed they will be monitored
• The device user has actively accepted the consent agreement presented by the Platform
• Camera and microphone access are only initiated with the device user's real-time approval for each session

3. Administrator Responsibilities

All administrators (master and secondary) are solely responsible for:

• Ensuring that all monitored device users have given informed consent
• Complying with all applicable local, national, and international privacy laws
• Using monitoring data only for the purposes disclosed to device users
• Maintaining the confidentiality of access credentials and dashboard data
• Ensuring secondary admin accounts are used lawfully within their organization

4. Prohibited Uses

You may not use Guardian Connected to:

• Monitor any person without their explicit knowledge and consent
• Stalk, harass, or surveil individuals in violation of applicable law
• Collect data for purposes beyond those disclosed to the device user
• Share account credentials with unauthorized parties
• Attempt to circumvent platform security, consent mechanisms, or access controls
• Use the platform for any illegal or unauthorized purpose

5. Account Suspension and Termination

We reserve the right to suspend or terminate any account that:

• Violates these Terms of Use
• Is found to be engaged in unauthorized or hidden monitoring
• Has an expired subscription that is not renewed
• Engages in fraudulent payment activity
• Violates applicable laws or regulations

6. Subscription and Payment Terms

Access to the Platform requires an active paid subscription.

• Subscriptions are activated immediately upon confirmation of PIX payment via Mercado Pago
• Subscription duration and pricing are as described on the Plans page
• Subscriptions are not automatically renewed — you must initiate renewal before the expiry date
• Expiry warnings are sent at 7, 3, and 1 day before expiration
• Expired subscriptions result in automatic account suspension; monitoring access is blocked until renewed
• Payments are non-refundable except where required by applicable law

7. Trial Use

Trial accounts may be offered at our discretion. Trial accounts:

• Are limited to one paired device
• May have restricted access to certain features (camera, microphone, reports)
• Are subject to the same consent requirements as paid accounts
• Will be converted to a paid subscription upon plan activation

8. Device Pairing Rules

• Devices must be paired using the QR code system provided by the Platform
• Each device pairing must be authorized by the device user
• Administrators may not exceed the device limit of their subscription plan
• Unpaired devices retain no data connection to the Platform

9. Data Privacy Obligations

By using Guardian Connected, you agree to handle all collected data in accordance with our Privacy Policy and applicable data protection law, including but not limited to:

• Brazil's Lei Geral de Proteção de Dados (LGPD)
• The EU General Data Protection Regulation (GDPR), where applicable
• Any local laws governing electronic surveillance and data collection

10. Limitation of Liability

Guardian Connected provides the platform "as is." We are not liable for any damages arising from misuse of the platform by administrators or device users, including unauthorized monitoring activities conducted in violation of these Terms.

11. Changes to Terms

We may update these Terms of Use from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
